WHAT PERSONAL DATA DO WE USE?

• Identification data: name, last name, date and place of birth, address, mobile phone number, fiscal code, e-mail address, IP address, image (optional)

• Educational and professional data: profession, work experience, qualification, languages spoken, educational qualification, and everything you provide us with your cv

• Recordings: audio e video (optional)

• Usage data: platform usage data, log (log-in, log-out, log-in updating, profile updating, creation /erasure video interview, expressed consents)


!! Please, do not add information related to your health, religious belief, racial or ethnic origin, political opinions, trade union membership or other sensitive information, it is not necessary!
However, if you believe that sharing with us your legally protected status (health related data) will be useful for a better evaluation of your profile or for the specific job position, we will ask your consent for the processing.
We do not ask information about criminal convictions and offences unless it is required by the law in relation with the specific job poistion you apply to.


WHY DO WE COLLECT AND USE YOUR DATA?

• To provide you with our search and selection Services in order to find you a job, also through employment staffing contract (data: identification data, educational and professional data, usage data). Our Services include: (i) creation of your account-profile on our platform; (ii) possibility for you to apply to specific positions (job post); (iii) evaluation of your profile also for different positions; (iv) receiving questionnaires about your knowledges; (v) possibility to receive new working opportunities; (vi) sending your data to potential employers (“long list” e “profile”, including only non-identifying data); (vii) opportunity to participate in training and career plans.
Why can we use the data? The legal basis of the processing, i.e., the condition required by the law to process the data, is the performance of the contract and your explicit consent in case you provide us with sensitive information necessary for the evaluation of your application.
Is it mandatory to provide the data? Yes. If you do not, we will not be able to provide you with our Services.
How long do we hold your data? 36 months after your last access to your reserved area on our platform.
If you find a job due to our Services: for the duration of the employment relationship and for other 10 years.

• To promote your profile through video interview (audio e video recordings).
Why can we use the data? The legal basis is your consent.
Is it mandatory to provide the data? No, it is always optional, if you do not record the video interview you can still use our Services but you will not promote your profile in an innovative way.
How long do we hold your data? 36 months after your last access to your reserved area, but you can withdraw your consent at any time.

• To send you promotional messages by email, concerning services, promotions o events organised by our company or our partners (name, last name, email address).
Why can we use your data? The legal basis is your consent.
Is it mandatory to provide the data? No, it is always optional, if you do not express your consent you will not be informed about our services, offers, events.
How long do we hold your data? 24 months, but you can withdraw your consent at any time.

• To ensure the security of your account and our platform (usage data).
Why can we use the data? The legal basis is our legitimate interest of ensuring the security of its systems.
Is it mandatory to provide the data? Yes. It is automatically collected when using the platform. It is not possible to use our Services without providing this information.
How long do we hold your data? Ordinary logs are kept for 7 months, last action for 36 months.

• If it is necessary to fulfil legal obligations or enforcement orders (some items or all data indicated above, depending on the obligation or order).
Why can we use the data? The legal basis is the compliance with a legal obligation.
Is it mandatory to provide the data? Yes. We will use the data required by the law.
How long do we hold your data? For the time set out by the law or by the authority.

• If necessary for the establishment, exercise or defence of legal claims related to the services provided (some items or all data indicated above, depending on the issue).
Why can we use your data? The legal basis is our legitimate interest of establishing, exercising, or defending our rights.
Is it mandatory to provide the data? We will use the data already collected for the purposes indicated above.
How long do we hold your data? For the time necessary for the establishment, exercise, or defence of legal claims.


HOW DO WE USE YOUR DATA THROUGH THE PLATFORM?
We provide you with a platform on which you can create your profile, apply to specific job position, record video interviews, interact with our recruiters. Do not forget to keep it updated!!
In order to apply to specific job posts or to send your cv spontaneously you have to create your account on our platform.
We have implemented security measures which ensure the confidentiality, the integrity and the availability of the data.
We ask you to generate a strong password for your account (do not use your name and surname, your email or other identifying information) and to hold it carefully.
We would like to inform you that in the contest of our personnel selection's activities we can rely on an advanced automatic system which allows us to select from the data base, through key words, our candidates' profiles which suit best for the position searched and to get a scoring of the different profiles.
Hence, we get a filtered selection of the information provided by the candidates, based on parameters such as, knowledges, education, job title, availability, which identifies a list of profiles suitable for the working position.
This is just a first automatic scoring since there is always the human intervention of the recruiter who evaluate other candidates' profiles.
This tool allows us to enhance and make more efficient our selection's process, and to provide an innovative service for our candidates and clients.


WHO WE CAN COMMUNICATED THE DATA TO?

• Our employees and contractors;

• Companies or consultants who provide us services (such as software and hardware
providers, platform's providers, email marketing providers, website providers) and process data on our behalf as data processors.

• Public or private entities to whom we are obliged to communicate the data in accordance with the law.

• Our clients/potential employers, in the contest of our selection's services and for the promotion of your application. Clients will process the data as data controllers.


WHERE ARE YOUR DATA?
We stored the data in the European Union. Some of our suppliers (IT services, hosting provider) are based outside of the European Union, such as Microsoft (based in the US) therefore your data can be accessed from outside the EU. We inform you that the data transfer will take place only in presence of adequate safeguards, such as an Adequacy decision or the Standard Contractual Clauses provided by the European Commission.

HOW DO WE SUPPORT YOU WITH YOUR RIGHTS?
Please, remember that you can access, correct and, in some cases, obtain the erasure of your personal data. You also have the right to restrict the processing of your personal data.
You can withdraw your consent at any time.
Moreover, you can receive a copy of your personal data or ask us to transmit that data to another controller, where technically feasible.
You can lodge a complaint with the supervisory authority of your country in case you think that your rights have been breached.

On grounds relating to your particular situation, you have also the right to object to processing of personal data which is based on the controller’s legitimate interest or for direct marketing.

GENERAL TERMS AND CONDITIONS OF USAGE NGAGE PLATFORM

I Description of the service, object of the service and registration


art.1 Description of the service offered through the Ngage platform
The aim of In Job Spa is to help the candidate establish a working relationship with the company’s clients or with In Job itself.
In order to optimize the management of applications and offer more opportunities to its candidates, In Job provides the Ngage platform that allows them to submit and manage their applications independently through the services offered within the portal (the "Services").


Art.2 Object of the Service
These terms and conditions govern the relationship between the candidate (also "user") and In Job Spa, with registered office in Verona, via Germania n. 1, with reference to the candidate's use of the Services offered through the Ngage platform. The Services include the main functionality of creation and management of candidate's personal profile and other accessory functionalities referred to in Section II of these Terms and Conditions.


Art. 3 Registration and creation of the account
In order to apply to specific job posts promoted by In Job Spa or to send spontaneous applications to our company, the candidate is required to register and create an account on the Ngage platform, filling out the data collection form truthfully, accurately and correctly. You will be asked to enter a username and password. Please, choose it carefully, avoiding: (i) using a password already in use for other online services (ii) entering references to your name, surname, date of birth, name of family members or pet or other information directly related to your identity.
Once you have completed the registration process, you will have a personal account on Ngage and a private area where you can manage your profile information.
We ask you to carefully protect the credentials of access to the platform and not to communicate them to third parties. The account and the use of the Services must be intended as strictly personal.
Each candidate is responsible for the confidentiality of his or her own profile. In the event of an account violation please contact us at hrtools@injob.com.


Art. 4 The main Services provided by In Job Spa
By creating the account, the candidate benefits from the following Services:
a) the possibility to apply for specific positions published by In Job Spa (job posts) or to apply for further future selections;
b) the evaluation of the profile also for job positions other than those for which the application was submitted if the profile is suitable;
c) the possibility to manage the information related to the profile and follow the selection process;
d) the possibility to answer questionnaires, for example, on languages or aptitude tests
e) the possibility to receive job offers in line with the profile;
f) the sending of the candidate’s data to potential employers as a "long list" and "profile" (containing non-identifying data: age of the candidate; location of domicile; educational qualification; professional experience; skills and competencies) in the first phase of the selection; the sending of identifying information only in the final phase of interviews;
g) the possibility to participate in training courses if the requirements are met.
As part of the research and selection activities we can use an advanced automated system that allows us to select, through keywords, the candidates in our database in line with the job profile sought and to perform a scoring of the applications.
Therefore, we get a filtered search on the information provided by the candidates, based on parameters such as skills, education, job title, availability, which identifies a list of profiles suitable for the job position.
This is just a first automatic scoring as there is always a human intervention by the recruiters to evaluate further profiles.
This system allows us to optimize and make the selection process more efficient, offering an innovative service to candidates and our clients.
The candidate acknowledges and accepts that the creation of the account implies the completion of all the activities indicated in this article, which are strictly necessary for the provision of the Services. Consequently, if the candidate does not intend to be provided with all the services listed, he/she is requested not to register on the platform.


art. 5 Sharing of data
The candidate provides his/her personal data by:
(a) filling in the fields marked as mandatory in the collection form on the website;
b) uploading their curriculum vitae ("cv") directly into the platform before completing registration.
The data included in the cv must be necessary and relevant for the purposes of evaluating the application, so candidates are required not to enter information defined as "particular" by art. 9 of the European Regulation no. 2016/679 (the "Regulation"), i.e., information about racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as data relating to health or sexual path or sexual orientation.
If a specific job position is addressed only to people with a legally protected status (related to health conditions) or if the candidate considers it useful to insert this information for the evaluation of the application, the processing of the related data will be carried out by In Job Spa after collecting the consent of the candidate.
The processing of personal data will take place in compliance with the privacy notice always available on the website and within the Ngage platform.

Sec. II Accessory services


Art. 6 Optional services
Optional services are available for the candidates who wish to further enhance his/her application.


Art. 7 Job Test
The candidate can take the Job Test, a test created to investigate soft skills, consisting of 46 questions. The test can be carried out directly in the candidate's personal profile, by clicking on the button, after having read the specific information on the processing of personal data and having given his/her consent.
The test involves a profiling, as the candidate, following answers to the questions, is assigned one of the profiles identified by the test.
The result of the test is considered together with other qualifications, experiences, interviews of the candidate in the selection process and is therefore not the only element considered in the selection process.
The test can be repeated after 3 months from the execution.

Art.8 Video interview
The candidate has the opportunity, at his own request or at the suggestion of the recruiter, to record a video interview to share with the potential employer to promote his application. The video interview will be carried out only after the candidate has given his or her consent to its use.
The video interview is an optional service and deciding not to do it does not have any consequences on the evaluation of the candidate in the selection.

SEC. III Unauthorized use, account deletion and limitations of liability


Art. 9 Unauthorized Use of Ngage
You shall not in any way use the Services for any unlawful purpose or illegal activity or post any content or advertisements that are defamatory, libellous, implicitly or explicitly offensive, vulgar, obscene, threatening, abusive, hateful, racist, discriminatory, threatening, or capable of causing outrage, discomfort, embarrassment, anxiety, or harassment to any person, or include links to pornographic, indecent, or sexually explicit material of any kind, as determined in the sole discretion of In Job Spa.
Candidate shall not use, copy, adapt, modify, prepare derivative works based on, distribute, license, sell, assign, publicly display, publicly perform, transmit, broadcast, or otherwise exploit any content on the Ngage platform, In Job Spa Services, or any portion thereof, unless expressly permitted by these Terms and Conditions.
Candidate shall not perform, attempt to perform or encourage, assist others in performing any of the following actions while accessing or using the Service: (1) use, mirror or framing the Service or any individual element within the Service, Ngage's name, any In Job Spa trademark, logo or other proprietary information, the layout and design of any page or form contained on a page without express written consent; (2) access or tamper with non-public areas of the platform, In Job Spa's or suppliers' computer systems; (3) test the vulnerability of the platform or breach security or authentication measures; (4) circumvent any technical measures implemented by In Job Spa or third parties (including another candidate) to protect its content; (5) modify, decompile, disassemble, reverse engineer, tamper with or otherwise attempt to infer the source code of the application provided to the candidate or any other part of the platform; (6) provide, during or after registration, false information regarding their identity; (7) attempt to access the account of another user.

Art.10 Cancellation and closure of the account
Candidates can deactivate their account, or delete their profile at any time, directly by accessing their area or by contacting In Job Spa at the DPO address: dpo@injob.com.
In Job Spa reserves the right to suspend or deactivate the account if:
a) it believes that you have breached your obligations under these Terms and Conditions
b) reasonably believes that a third party is using the account without the consent of the candidate
c) reasonably believes that your use of the account may cause damage of any kind;
d) reasonably believe that your use of the account may violate any law or regulation.
Your account will be directly deactivated, and your profile deleted, if you do not use your account for 36 consecutive months. The 36 months start from the last activity performed by the candidate on his/her profile (accessing the profile). Four months before the expiry of the 36-month period, the candidate will be notified of the next deletion.


Art. 11 Compensation and limitation of liability
In Job Spa shall not be responsible in case of failure to comply with the obligations provided for, if the failure is caused by (i) third parties; (ii) dysfunctions of computer systems not under the direct control of In Job Spa, or (iii) other events beyond the control of In Job Spa.
To the extent permitted by applicable law, In Job Spa shall not be responsible for any loss of profit, contracts or any incidental or indirect damages or expenses resulting from your use or inability to use the Services.
Except as required by mandatory law, In Job Spa makes no warranties of any kind, express or implied, including warranties relating to adequacy, accuracy, reliability of the Services and platform content.


Section IV: Miscellaneous


Art. 12 - Use and interruption of the Service
To use the platform Services a compatible device owned by the candidate and access to an Internet connection are required. In order to guarantee candidates with the best possible use of the platform, In Job Spa reserves the right to interrupt the Services for maintenance or system updates, informing users in advance.


Art. 13 - Updating the Terms and Conditions
These Terms and Conditions may be subject to change. In such circumstances, In Job Spa will notify candidates by email or through push notifications. Once the updated Terms come into effect, the Candidate's acceptance will be deemed implicit in the case of continued use of Ngage.
We hope that you will continue to use our Services. However, if the candidate does not accept our updated Terms, he/she can delete his/her account at any time.


Art. 14 Assignment of Contract
The candidate hereby accepts that In Job Spa may assign these Terms and Conditions (even in case of transfer of a company or a branch of a company) and by accepting these expresses its prior consent to the assignment. The candidate will be notified in advance of this assignment and the relative execution modalities.
The candidate shall not assign these Terms and Conditions. In case of violation of this prohibition, assignment will be considered as not occurred and therefore without effect.


Art. 15- Intellectual property rights
The candidate shall access the platform exclusively to use the Services and in compliance with the provisions of these Terms and Conditions. No part of the platform, the website or the Services may be reproduced in any form or by any means. The candidate agrees not to modify, rent, lease, lend, sell, distribute, or create derivative works based on the Services provided.


Art. 16 - Age requirements
Services of the platform are reserved for candidates who are at least eighteen years old.


Art. 17 - Applicable law and jurisdiction
These Terms and Conditions are governed by Italian law. The applicable jurisdiction is the Italian one and any dispute will be resolved exclusively by the Court of Verona.
